I really don't see how calling a Congresswoman to state the obvious is a problem. This is far from controversial.
If IV comes up with a plan of action then fine, but each of us has an individual duty to speak up about CIS' affirmative misconduct.
My point is merely that we should not wait for
(a) inevitable disaster to strike
(b) complete set of data on usage (which we will never really get)
(c) perfect plan
before we act.
We need to alert Lofgren and the House Subcommittee that they should start monitoring and asking questions and putting the pressure on CIS NOW. Not in the fourth quarter. This strategy has already paid off for citizenship applicants (they have hired extra staff, and may have reallocated staff away from greencards).
Absolutely everbody should be able repeat the figures on p.34 of the 2007 Ombudsmans report like a mantra, in order to justify why Lofgren et al MUST ACT NOW. See http://www.dhs.gov/xlibrary/assets/CISOMB_Annual_Report_2007.pdf. In case anyone needs a reminder -- in 2003-2006 alone they threw away 146,085 EB greencards, i.e. more than an entire YEARS supply. They would have done the same last year if it wasn't for the hue and cry and DOS making the date current (the Ombudsman said they were on course to waste 40K last year, see 2007 report). We just need to stop that this year, and stop it early.
Which also means that we as a community shouldn't spend a lot of time before taking action. This is a totally straightforward issue.

I fully agree with you.. not quoting the name of the attorney.. I made this mistake of visiting this attorney in Baltimore ..just because the attorney was very well known probably because of the website.. ended up paying for $ 300 for a 30 minute consultation with an assoicate..and believe me I knew more about PERM and immigration then this associate. and the worst part was that I had give the check upfront.... on the other hand Rajiv Khanna gives free advise and also takes pro bono cases for people who cannot afford..and that speaks a lot for an immigration attorney.
yes true. I had to do a little bit of shopping before I selected one. Several lawyers wanted consulatation money upfront before I even decide if I want that lawyer. In some cases I declined to pay and asked for a free first meeting. Some lawyers then agreed to meet me for no charge. Ask them about their clients and any references. Ask them number of cases handled in a particular catagory.
Ask them about their education and lawfirm. basically take their interview insted of being at their mercy.
make sure you hire the attorney for your case and not your company hiring their company lawyer.A company lawyer will work in the interest of the company and not in your interest. if you dont have that control, then you let your company hire their attorney for their application and you hire your own attorney for all consulations and also to run all documents by him at every stage of the process. you will be surprised to see glaring errors made by big lawfirms in your applications. Most of the time , these applications are filled by paralegals and trainees. Sometimes small law firms pay more individual attention than large firms. You need to weigh all options before selecting one lawyer. make sure you have his phone number and email with you and make an agreement that he will respond asap whenever you need him (even from the airport when you land here after a trip to your home country and you get into problem). I know it is a bit much to ask from a lawyer, but if you do this you will ultimately get a lawyer who will care for your case.

if there is no person with the name of Arun Vakil working or was working in the Mumbai consolate , then
1) you should not feel offeneded and take time off from you busy schedule to try explain this
2)If you do not work in the mumbai consolate or are associated with the mumbai consolate , how do you that there is no person who was working in the consolate
is it safe to assume either that you have access to all the list of persons in the consolate
or you are GOD cause only God can tell us all the name of persons working
in the consolate , and i strictly believe that it not the later , you might be the opposite of GOD
But this is not going to end here , it is just the begining
as you might be aware that i can show you proof if things get out of hand

I am sure you must have spent a lot of money on the whole GC process. $300 for EAD should not make you think so much. Better be safe than sorry!
I hope you get the 485 approval soon, so there is no dilemma. If I were you, I would apply for EAD.

There was another thread where someone was in the same situation..Looks like for USPS mail, someone from USCIS has to go and pick it up or something and they do that every day at 5:00 AM as per some post/reply on that thread......You might want to search for that thread as it was either posted this morning or yesterday....From the comments on that thread, seems like this is normal procedure if pkg is sent through USPS....

Pappu, may be you can make this an ACTION ALERT for the forum members.
Folks consider this doing asap, this I believe is THE MOST IMPORTANT thing to do NOW.
this tool is an action alert on
http://immigrationvoice.org/index.php?option=com_content&task=view&id=69
however we have got very lukewarm response till now. We need to really focus on this. Strength is in numbers and in order for something to happen for all of us, we need to ensure we have all the muscle we need. This is an important task in which we all need to participate. It doesnt even cost you any money. just few minutes of your time is all you need to contribute!!

HI! Any body please respond my question. My wife came to US on H4. After a year she paid $1800 to a recruiter and took H1B in the year 2004. She got pregnant and couldn't work. Her H1B came with an I-94 and it was valid till Oct.2007. Last May we visited India and went to consulate for stamping. As she never worked on H1B, she was again stamped with H4 and entered into US again on H4. Later she came to know that she lost her H1B status and H1B approval she has is totally invalid. Now again she wants to apply for H1B. Now recruiter is asking $3000. But still we are in doubt about H1B approval as we have the following questions. Any one please advise us.
Her H4, I-94 is valid till Mar.23 2007. She is going to apply for H1 on Apr.2nd as Apr.1st is holiday. Is she going to get H1B approval with out I-94 as she doesn't have approved H4 I-94?
If so, does she need to go to India for stamping?
Is there anything we can do with our old H1B as its validity is till Oct.2007.
Does she comes under 65K cap?
Thanks in advance.

3. I consulted my lawyer and they are saying that my wife can get her H4 stamp but at the port of entry she has to use AP to get in ?
If your wife has to use AP at POE, then why take the pain of gettng the visa stamped? From what we were told by our attorney once you have your AP there is no need to take the pain to get the H1/H4 stamped. In our attorneys perspective H1/H4 is like a secondary insurance in case your 485 get rejected, you can continue working on H1, while you do the appeal.
Someone else may have a different opinion for as to why get the visa stamped.

Am in the same boat. My PD is close to current - but haven't received FP yet. Tried calling USCIS, took Infopass appointment - nothing happened. Asked my lawyer to fax out requests to TSC (seems like a new hotline number has been opened). Keeping my fingers crossed.

I sent you PM .. please check..
I think we are doing a fantastic job with this first rally, but at this time we are in the street only a cheap level for a movement. (Only flyers).
- I dont see an editorial in the news papers (Post or times)
- I dont listen about us in the talk shows.
- I dont see a celebrity involved
- I dont see sponsors or big mony supporting us (just our contributions)
- Do the prensidential candidates know about us???
So what momentum are we talking about? why dillute our energy in a second rally if we still have high goals to reach in this one.
I only see very enthusiastic guys trying to grup in a high ideoligical movement, but thats it....
Honestly, I dont want to be in rallies all the time, we are highly skilled immigrants (fancy master degrees!!!!!!!) lets look for the big picture lets go for a sixth grade campaign, lest use our knowledge and high potential..
Innovative new ideas... (high result! !!!)
We thing in flowers campaign, we look sponsors, we look for a air time in the broadcasts. why not get an interview with Lou Dobbs... Lets get into a high level campagin.
Im pushing and working on that...
Only Illegals think in rallies for ever......

Thanks! I get that feel too, atleast for now. But I am also worried if this mistake is later on identiied by USCIS, then will it work against me and deny my 485 / EAD.
So I seeking some wisdom in this forum. Are you suggesting they will not come around and tell that you should have informed us of this mistake.

ok..finally I got my interview letter for Aug25th.
Note: Calling USCIS helps..it was just a coincidence, that today morning I was able to get to Level-2 customer service and she told m that our interviews are scheduled for aug25th..and noon we got letters.. :D
One important thing is, our PD is mentioned incorrectly on interview notices.
Both PD and RD is Aug 8th, 2007, which is infact my RD.
My PD is Dec 2005.
Has anyone in the same boat or does it matter during the interview for approval?
